Writ against capital of Province 7 in forest

KATHMANDU: A writ petition has been filed at Supreme Court against the decision of Far-Western Province to make its capital by damaging the forest.

The Far-Western Province recently decided to make its capital at Godavari Municipality of Kailali district by cutting down trees of Teghari Community Forest Users’ Group, spread at Ward No 2 and 4 of the municipality. However, a writ petition has been filed at the apex court against the decision of the province.

Advocate Dev Kumari Joshi filed the writ against the decision of making capital by damaging biodiversity and Chure-Bhavar forest zone of international importance. Joshi, who hails from Dhangadhi Sub-Metropolitan City-5, has been currently living in Kathmandu.

The writ is against the Office of Prime Minister, Chief Minister of the province, speaker of provincial house and coordinator of special committee formed to name the capital city of the province.

According to the writ, the defendants defied the spirit of Nepal’s Constitution 2015, 133 (2 and 3), which does not allow to select the land of forest for the land while deciding the capital city. It has sought interim order to stop the process of making capital city at Godavari as per the Supreme Court Regulations (49).

“It is the concern of all people that is related to the far sighted issue and damage of forests. So it should be looked under the prerogative rights,” the writ says.
